Different asset regimes

Planning the wedding also means thinking about how you will manage your finances and that also means choosing a type of asset scheme to adopt in your marriage. The property regime chosen by the couple is usually spelled out in the prenuptial agreement.

Marriage with Partial Communion of Goods Regime

This is the regime that is currently the most used by couples. When there is no adopted regime, this is automatically the current one. But how does it work?

In the partial property regime, all assets acquired after the date of marriage are the property of the couple. The assets that were owned by each other before marriage remain theirs and need not be divided if divorce occurs.

Marriage with the Universal Communion of Goods Regime

In marriages with universal communion of property, all property owned by both spouses becomes the property of the couple. Therefore, when either of them dies, the heirs may keep half their possessions while the spouse still alive is left with the other half.


Marriage with Separation of Goods Regime

Under this scheme, all assets belonging to each remain the property of each spouse. Thus, couples in separation do not share their possessions, each one gets what is owned by him.

There are some special situations in which this scheme becomes compulsory, for example when the couple is engaged under the age of 16 or over 60.

Marriage with Final Participation Regime

In this regime, each one has its own equity and manages it. As for the goods purchased by the couple together, these should be shared half to each spouse if the marriage ends.

However, it is noteworthy that the property regime chosen by the couple in the prenuptial agreement can be changed after marriage by court order if both agree to the amendment.
